Comedian Jim Davidson denies fresh sex allegations

Comedian Jim Davidson answered bail on Wednesday after he was held in January by detectives working on Operation Yewtree

21 March 2013

Comedian Jim Davidson "vigorously denies" allegations made against him, his solicitor said last night following the star's re-arrest for further alleged sex offences.

The 59-year-old answered bail yesterday.

His solicitor Henri Brandman said: "Jim vigorously denies the allegations. He has not been charged with any offence. Neither he nor I will be making a further comment."

The former Big Break and Generation Game host answered bail yesterday after he was held in January by detectives working on Operation Yewtree, the national investigation prompted by the Jimmy Savile sex abuse scandal.

A Scotland Yard spokesman said a 59-year-old man had been "further arrested on suspicion of sexual offences in connection with further allegations made to Operation Yewtree".

He and a 53-year-old man were arrested in January. They both answered bail yesterday and have again been bailed until May

Jimmy Savile investigation: officers arrest 82-year-old man11th suspect arrested as part of Operation Yewtree bailed until May after being held on suspicion of sexual offences

An 82-year-old man has been arrested on suspicion of sexual offences by police investigating allegations arising from the Jimmy Savile scandal.

The suspect, from Berkshire, was arrested on Thursday and bailed to a date in May pending further inquiries. He is the 11th person to be arrested by officers from Operation Yewtree, which was set up to examine allegations of abuse against Savile and others.

The man was originally interviewed under caution by officers on 29 November after a search warrant was executed at an address in Berkshire five days earlier. Police said the individual falls under the strand of the investigation which is looking at complaints against people who are not connected to Savile.

Several high-profile figures have been arrested in connection with the investigation including PR consultant Max Clifford, comedian Freddie Star, DJ Dave Lee Travis, former TV producer Wilfred De'Ath and comedian Jim Davidson. They all deny any wrongdoing and De'Ath was this week released without charge.

A police report released in January revealed that Savile abused children across six decades at 14 hospitals including Great Ormond Street while working as a DJ and TV presenter at the BBC.

Commander Peter Spindler of the Metropolitan police said Savile had used his fame and celebrity status to "hide in plain sight" and had "groomed the nation".

Max Clifford vows to clear name after sex charges

Max Clifford reads a statement to the media outside his home in Surrey after he was charged with 11 historic counts of indecent assault against teenage girls.

PR guru Max Clifford has vowed to clear his name in court after he was charged with 11 historic counts of indecent assault against teenage girls.

The 70-year-old, famed for representing celebrities including Simon Cowell and Jade Goody, said he has been “living a 24/7 nightmare” since his arrest in December.

Clifford was charged with offences linked to girls aged from 14 to 19 between 1966 and 1985 and will appear at Westminster Magistrates’ Court on May 28.

He was arrested as part of Operation Yewtree, the national police inquiry sparked by allegations of abuse against Jimmy Savile.

Clifford told the Press Association: “The allegations in respect of which I have been charged are completely false and I have made this clear to the police during many, many hours of interviews. Nevertheless a decision has been taken to charge me with 11 offences involving seven women, the most recent of which is 28 years ago and the oldest 47 years ago. I have never indecently assaulted anyone in my life and this will become clear during the course of the proceedings.”

Later outside his home in Surrey, an emotional Clifford told reporters: “The allegations in respect of which I have been charged are completely false, very upsetting, very distressing, but completely false.

“I have made it clear to the police during probably around 25 hours of interviews since last December when I was initially arrested, that there’s absolutely no truth and substance in any of these allegations.”

The Crown Prosecution Service (CPS) found that there was insufficient evidence to bring charges in relation to three other allegations made against Clifford.

Alison Saunders, Chief Crown Prosecutor for CPS London, said: “We have carefully considered the evidence gathered as part of Operation Yewtree in relation to Max Clifford, who was initially arrested on December 6 2012 over allegations of sexual offences.

“Having completed our review, we have concluded that there is sufficient evidence and it is in the public interest for Mr Clifford to be charged with 11 offences of indecent assault relating to seven complainants.”

Broadcaster Stuart Hall admits indecent assaults

BBC broadcaster Stuart Hall has admitted 14 charges of indecently assaulting girls including one aged nine.

The 83-year-old of Wilmslow, Cheshire, pleaded guilty at Preston Crown Court to the offences, involving 13 victims, which occurred between 1967 and 1985.

Three charges of indecent assault and one of rape will lie on the court file.

His lawyer said Hall apologised to his victims and added: "He is all too aware that his disgrace is complete."

He has been bailed until sentencing on 17 June.

A BBC spokesperson said: "The BBC is appalled by the disgraceful actions of Stuart Hall and we would like to express our sympathy to his victims. We will continue to work with the police to assist them in this and any other inquiries they are making."

Stuart Hall arrives to admit 14 counts of indecent assault against children Stuart Hall admits indecent assaults

'Opportunistic predator'

Hall admitted the offences last month but they could not be revealed due to reporting restrictions.

Chief Crown Prosecutor for the North West, Nazir Afzal, described Hall as an "opportunistic predator".

He added: "We prosecuted Stuart Hall because the evidence of the victims clearly established a pattern of behaviour that was unlawful and for which no innocent explanation could be offered.

"His victims did not know each other and almost two decades separated the first and last assaults but almost all of the victims, including one who was only nine at the time of the assault, provided strikingly similar accounts.

"Whether in public or private, Hall would first approach under friendly pretences and then bide his time until the victim was isolated.

"I would like to thank the victims for having had the bravery to come forward. This case clearly shows that the victims of abuse will not be denied justice by the passage of time and abusers will be held to account."

Mr Afzal said the Crown Prosecution Service (CPS) would not be proceeding with the rape charge as the woman who made the allegation no longer wished to give evidence in light of the guilty pleas.

Anyone remember Peter Adamson who played Len Fairclough? His fingers had a habit of finding their way into little girls' swim suits in his local pool. The scriptwriters killed off the character in a way that expressed their disapproval of the actor's wandering digit.

When Savile died and a victim dared to make a complaint about him, a huge can of worms was opened. Many victims of abuse in those days kept quiet because no-one wanted to listen. Other, perhaps in their early teens, appeared to consent to the abuse but, in law, that's impossible. Once the dam was broken, other came forward and other alleged abusers were named. The scandal involves those in the police force and the BBC who kew about Savile and others and covered it all up. I think it has a long way to go before it's finished.

Some people are saying that the investigations are, after all this time, a waste of time and money, partly because evidence will be lacking. Well, Stuart Hall has admitted to the charges against him so that one certainly isn't a waste of time. What's especially important is that victims who have carried emotional pain for decades now have the opportunity to exorcise their demons.

I see that the Deputy Speaker of the House is in some bother to do with raping men.

Saf I agree. The scale of these revelations is stunning and it is good that the truth is out. It is a national scandal that these facts have been suppressed for so long.
These Guys, immersed in success, adulation, money and probably with plenty of attention from beautiful adult women, want to abuse kids - it is totally sick.
As an aside only - I've seen no cases of Women being accused of abuse in this wave of disclosures.

Saf. Yes Nigel Evans. A DM headline and a picture of him being driven away in a Bentley.
At the moment, these are allegations from 2 men in their 20's. Time will tell.
But UK society and the celebrity scene, looks to have a pretty sordid history lately.

If the full truth were known, I expect that the Establishment, meaning Parliament, judiciary, churches and police forces, would be turned on its head. The truth is largely hidden by these institutions, partly to protect themselves. Usually, a few sacrificial lambs are brought to justice to keep the public happy but the huge paedophile networks continue undetected.

It's probably safe to say, Roger, that most abusers are men. However, there are females involved in abuse. Some are active, others support male abusers. Myra Hindley and the West woman are examples. I would estimate that most women involved in abuse are those who turn a blind eye, such as the mothers of abused children who fear for the financial future of the family if the father is locked up.

Now Jimmy Tarbuck

Veteran comedian Jimmy Tarbuck has been arrested in connection with a historic child sex abuse allegation, sources said.

Tarbuck, 73, was questioned by North Yorkshire Police on April 26 in relation to an incident which allegedly occurred in the late 1970s in Harrogate, North Yorkshire, when the victim was a young boy.

The TV personality's name had not been revealed until the Daily Mail named him on Sunday night. It is understood he was arrested at his home in Kingston Upon Thames, south-west London, and released on bail.

The arrest was made following information passed by Metropolitan Police officers working on Operation Yewtree to North Yorkshire Police.

A force spokesman said: "North Yorkshire Police can confirm that a 73-year-old man has been arrested in connection with a historic child sex abuse investigation in Harrogate. The man was arrested in Kingston Upon Thames on Friday 26 April 2013. Following questioning, he was released on police bail pending further inquiries. The complaint relates to an incident that occurred in the late 1970s when the victim was a young boy. It would not be appropriate to comment further at this stage."

Jimmy Tarbuck is known for being a comedian who has spent more than 50 years in television.

Born in 1940 in Liverpool, he was a schoolmate of John Lennon and his first television breakthrough came with It's Tarbuck 65! in 1964. He hosted numerous quiz shows, including Winner Takes All and Full Swing.

In 1994 he was awarded an OBE by the Queen for his services to showbusiness and charity. Last November he performed in The Royal Variety Performance at the Royal Albert Hall in London.

His daughter is the actress, television and radio presenter Liza Tarbuck.

Mr Tarbuck's agent could not be reached for comment for on Sunday night.

If Jimmy Tarbuck is guilty of this alleged offence, they should throw the book at him.
But after say 40 years, how do can you actually prove something like that without reliable witnesses ?
Jimmy Saville and Stuart Hall  seem obviously guilty by sheer weight of numbers.
But everyone in the pubic eye can now be a target for such allegations which might be untrue and motivated by design, malice or delusion.
And even if innocent, their reputations are stained forever. A new McCarthyism.
HOWEVER, it is truly horrifying that 'conspiracies of silence', the BBC and the Roman Catholic Church to name but two, have allowed offenders to go unpunished AND to continue offending. Absolute shame on those involved.

I thought that McCarthyism was about Communist celebrities, not justice for victims of abuse in childhood.

I don't care how long ago the offences took place. The victims have suffered the results of abuse all their lives and perpetrators should face justice however long ago they committed their crimes.

The age of consent for sex should be lowered to 13 years-old to end the ''persecution of old men'' in the wake of the Savile sex abuse scandal, a leading barrister has claimed.
In a controversial intervention, Barbara Hewson, a senior barrister at Hardwicke chambers in London, also called for the end of anonymity for complainants.

The lawyer, who specialises in reproductive rights also claimed crimes committed by disgraced broadcaster Stuart Hall were ''low level misdemeanours''.

Campaigners today criticised the ''outdated and simply ill-informed'' views, which it said ''beggars belief'' from a highly-experienced barrister.

Her article also provoked an internal row within her chambers, which launched an "investigation" into the claims.

But amid the storm of condemnation, she stood by her comments today as she quoted François-Marie Arouet, the 18th century philosopher, in her bid to defend her "opinion".

Her comments come as Scotland Yard operates Operation Yewtree, an investigation split into three inquiries into allegations involving deceased presenter Jimmy Savile, involving Savile and others and those involving just others.

A number of high-profile figures have been arrested under Yewtree such as entertainer Rolf Harris, former pop star Gary Glitter, DJ Dave Lee Travis, comedian Jim Davidson and PR guru Max Clifford. All deny any wrongdoing.

In an article for online magazine Spiked, she argued that ''the post-Savile witch-hunting of ageing celebs echoes the Soviet Union'' and says that it is not difficult to see why some elderly defendants ''conclude that resistance is useless''.

She added: ''But the low-level misdemeanours with which Stuart Hall was charged are nothing like serious crime.''

''Ordinarily, Hall's misdemeanours would not be prosecuted, and certainly not decades after the event.

''What we have here is the manipulation of the British criminal-justice system to produce scapegoats on demand. It is a grotesque spectacle.''

She continued: ''It's time to end this prurient charade, which has nothing to do with justice or the public interest.''

The barrister added: ''Instead, we should focus on arming today's youngsters with the savoir-faire and social skills to avoid drifting into compromising situations, and prosecute modern crime.

''As for law reform, now regrettably necessary, my recommendations are remove complainant anonymity, introduce a strict statute of limitations for criminal prosecutions and civil actions and reduce the age of consent to 13.''

Ms Hewson argued that ''touching a 17-year-old's breast, kissing a 13-year-old, or putting one's hand up a 16-year-old's skirt'' are not comparable to cases such as the Ealing Vicarage rape or Fordingbridge gang rape and murders from 1986.

She added: ''Anyone suggesting otherwise has lost touch with reality.''

Ms Hewson also labelled charities such as the National Society for the Prevention of Cruelty to Children (NSPCC) and the National Association for People Abused in Childhood (Napac) as ''moral crusaders'' who have infiltrated Yewtree.

Today, she stood by her article. "Good journalists stand by what they write and so do I," she said in a statement to The Daily Telegraph.

"Like Voltaire, we must defend the right to express our opinions. Incidentally I have had a wave of polite emails from strangers saying how much they appreciated my piece in spiked."

She had earlier posted on Twitter how she was the subject of abuse from users in the wake of her article.

Hardwicke today distanced the chambers from the article.

A spokesman added: "We are shocked by the views expressed in Barbara Hewson’s article in Spiked.

"We did not see or approve the article pre-publication and we completely dissociate ourselves from its content and any related views she may have expressed via social media or any other media outlets."

Frances Swaine, managing partner at law firm Leigh Day, which represents one of Savile's victims as well as a dozen other victims of historic sexual abuse, said: "Our clients would be distressed by any suggestion the age of consent should be reduced to 13 or to hear their abuse defined as 'low-level misdemeanours'.

"This debate does nothing to help society come to terms with the criminal behaviour identified by historic sexual abuse survivors."

Peter Watt, director of the NSPCC helpline, also attacked the barrister.

He added: ''These outdated and simply ill-informed views would be shocking to hear from anyone but to hear them from a highly experienced barrister simply beggars belief.

''Stuart Hall has pleaded guilty to abusing children as young as nine years old, we think most people would agree that crimes of this nature are incredibly serious. Thankfully the law, and most people, are very clear on this matter.

''To minimise and trivialise the impact of these offences for victims in this way is all but denying that they have in fact suffered abuse at all. Any suggestion of lowering the age of consent could put more young people at risk from those who prey on vulnerable young people."

He added: ''And we must strongly defend the right for victims to remain anonymous and to ask for justice no matter when they choose to come forward.

''Many who are abused are bullied, blackmailed and shamed into staying silent, often well into adulthood. We must always be prepared to act no matter how long ago the abuse occurred.

''The actions of those who speak out also protect others from abuse and give confidence to other victims to come forward.''

A spokesman from the Bar Council said: "Any sexual offence or allegation of a sexual offence, particularly where the complainant is under the age of consent, should be treated with the utmost seriousness.

"These types of offences can destroy victims' lives. They are not trivial and it would be wholly wrong for anyone to suggest otherwise."

Ms Hewson is regularly ranked as a Leading Junior by The Legal 500 in the fields of public and administrative law, human rights and civil liberties, and professional discipline and regulatory law, according to her chambers' website.

She has won cases in the European Court of Human Rights, the Supreme Court and High Court of the Republic of Ireland.

bit more here

We have been here before. England has a long history of do-gooders seeking to stamp out their version of sexual misconduct by force of the criminal law. In the eighteenth century, the quaintly named Society for the Reformation of Manners funded prosecutions of brothels, playwrights and gay men.

A lawyer for the entertainer Jim Davidson said his client has not been interviewed over an alleged historic sexual offence carried out in the Falkland Islands.

Davidson, who was rebailed by detectives from Operation Yewtree - the probe launched in the aftermath of the Jimmy Savile scandal - was originally arrested by Scotland Yard in January over allegations of historic sexual offences against women in the UK.

The 59-year-old has not been charged and has been bailed to July.

It was reported that Yewtree detectives were carrying out an investigation on behalf of the Royal Falklands Island Police into an accusation that the comic indecently assaulted a woman while he was on tour and entertaining British troops.

Davidson's solicitor Henri Brandman said: "Jim continues to vigorously deny the allegations that have been put to him and is helping the police as fully as possible in their inquiries.

"He has not been charged with any offence.

"Jim has not been interviewed in respect of any alleged incident with a woman suggested to have taken place in the Falkland Islands about 30 years ago.

"Unless and until he is interviewed on that subject, neither he nor I can make any comment in that respect."
